These Website Terms of Use (the “Terms”) govern access to and use of goape.com and related online services. The Terms explain the rules that apply when you use the Go Ape website, online booking pages, customer portals, and other digital services that link to these Terms. Reservations, purchases, participation in Activities, and collection and use of personal information are also subject to separate Booking Terms, Privacy Policy, Rules of Participation, and participant Assumption of Risk and Release of Claims form, and any other product, transaction or promotion specific terms. Capitalized terms not defined in these Terms have the meanings given to them in the Booking Terms.

1. Acceptance of Terms

These Terms are a binding agreement between you and Adventure Forest LLC, together with its applicable parents, subsidiaries and affiliates (collectively, “Go Ape,” “we,” “us,” or “our”). These Terms govern your access to and use of goape.com, its subdomains, online booking pages, customer portals, and other digital services that link to these Terms (collectively, the “Website”).

By accessing or using the Website, you acknowledge that you have read and agree to these Terms. If you do not agree, do not use the Website. If you use the Website on behalf of an organization, you represent that you have authority to bind that organization to these Terms.

Additional terms may apply to particular transactions or services, including the Booking Terms; Passes, Memberships & Gift Cards Terms; promotion-specific rules; and our Privacy Policy. If these Terms conflict with terms specifically governing a transaction, product, or promotion, the more specific terms will control with respect to that transaction, product, or promotion.

3. Eligibility and accounts

You must be at least 18 years old and legally able to enter into contracts to make a purchase, unless a parent or legal guardian completes the transaction as permitted by applicable law. You are responsible for providing accurate information, safeguarding account credentials and booking codes, and notifying us promptly of suspected unauthorized use.

4. Permitted use

Go Ape grants you a limited, revocable, nonexclusive, nontransferable right to access and use the Website for personal, lawful, non-commercial purposes, including researching activities, making reservations, managing eligible bookings, purchasing authorized products, and contacting us.

5. Prohibited conduct

You may not, and may not assist another person to:

  • use the Website for unlawful, fraudulent, deceptive, harassing, abusive, or harmful purposes;
  • impersonate another person or misrepresent your identity, authority, affiliation, age, or eligibility;
  • attempt to gain unauthorized access to the Website, accounts, systems, networks, or data;
  • introduce malware, malicious code, or other harmful material;
  • interfere with the operation, security, integrity, or availability of the Website;
  • use bots, scripts, scraping tools, or other automated means to access, copy, monitor, reserve, or extract Website content or inventory, except with our prior written permission or as permitted by law;
  • circumvent access controls, rate limits, purchase limits, promotion rules, or security features;
  • reverse engineer, decompile, or attempt to derive source code from Website technology, except to the limited extent such restriction is prohibited by law;
  • use Website content to create a competing service, build a commercial database, or train an automated model without our prior written permission;
  • submit false payment information, initiate fraudulent chargebacks, or resell reservations, codes, memberships, or promotions without authorization; or
  • infringe intellectual-property, privacy, publicity, contractual, or other rights.

6. Website content and intellectual property

The Website and its text, graphics, photographs, videos, audio, software, design, trademarks, logos, trade dress, databases, and other content (“Content”) are owned by or licensed to Go Ape and are protected by applicable intellectual-property laws. Except for the limited right granted above, no right, title, or interest is transferred to you.

You may download or print a reasonable number of pages for personal, noncommercial use, provided you do not remove notices or alter the Content. Any other reproduction, distribution, public display, modification, sale, licensing, or commercial use requires prior written permission.

7. User submissions and feedback

If you submit reviews, photographs, videos, comments, contest entries, ideas, feedback, or other content (“User Content”), you represent that you own or have the rights necessary to submit it and that it does not violate law or another person’s rights. You grant Go Ape a nonexclusive, worldwide, royalty-free license to host, reproduce, display, adapt, distribute, and otherwise use User Content for the purpose for which it was submitted and for related business, promotional, and operational purposes, subject to applicable law and our Privacy Policy.

We may remove or decline to use User Content in our discretion. Do not submit confidential information through public-facing features. Suggestions and feedback may be used without restriction or compensation, unless otherwise agreed in writing.

8. Bookings, pricing, and availability

Reservations and purchases are subject to availability and the applicable transaction terms. Prices, descriptions, operating hours, and inventory may change. We may correct typographical, technical, inventory, or pricing errors and may cancel or refuse a transaction affected by an error, subject to applicable law. A booking is accepted only when we issue a confirmation.

The Website may link to or integrate with third-party services, such as payment processors, booking platforms, mapping services, social networks, or park partners. Go Ape does not control third-party services and is not responsible for their content, availability, security, or privacy practices. Your use of a third-party service is governed by that provider’s terms and policies.

10. Privacy and cookies

Our Privacy Policy explains how we collect, use, disclose, and retain personal information. Our cookie banner or privacy-preference center provides information and choices regarding cookies and similar technologies. By using the Website, you acknowledge the data practices described in those notices; where consent is legally required, we will request it separately.

11. Availability and changes to the Website

We may modify, suspend, restrict, or discontinue all or part of the Website at any time. We do not guarantee that the Website will always be available, uninterrupted, secure, or error-free. We may perform maintenance and may impose reasonable limits to protect users, systems, inventory, and operations.

TO THE FULLEST EXTENT PERMITTED BY LAW, THE WEBSITE AND CONTENT ARE PROVIDED “AS IS” AND “AS AVAILABLE.” GO APE DISCLAIMS ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE WEBSITE WILL BE ACCURATE, COMPLETE, CURRENT, UNINTERRUPTED, ERROR-FREE, OR FREE OF HARMFUL COMPONENTS.

13. Limitation of liability

TO THE FULLEST EXTENT PERMITTED BY LAW, GO APE AND ITS OWNERS, MEMBERS, AFFILIATES, MANAGERS, OFFICERS, EMPLOYEES, AGENTS, AND SERVICE PROVIDERS WILL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, EXEMPLARY, PUNITIVE, OR CONSEQUENTIAL DAMAGES, OR FOR LOSS OF PROFITS, REVENUE, DATA, GOODWILL, OR BUSINESS OPPORTUNITY, ARISING FROM OR RELATED TO USE OF OR INABILITY TO USE THE WEBSITE.

TO THE FULLEST EXTENT PERMITTED BY LAW, THE AGGREGATE LIABILITY OF THE FOREGOING PARTIES FOR CLAIMS ARISING SOLELY FROM USE OF THE WEBSITE WILL NOT EXCEED THE GREATER OF (A) THE AMOUNT YOU PAID TO GO APE THROUGH THE WEBSITE DURING THE SIX MONTHS BEFORE THE EVENT GIVING RISE TO THE CLAIM OR (B) ONE HUNDRED DOLLARS ($100.00). THESE LIMITATIONS DO NOT APPLY TO LIABILITY THAT CANNOT BE LIMITED BY LAW.

14. Indemnification

To the extent permitted by law, you agree to defend, indemnify, and hold harmless Go Ape and its members, affiliates, officers, directors, employees, and agents from third-party claims, losses, liabilities, and reasonable costs arising from your unlawful use of the Website, your User Content, or your material breach of these Terms. This provision does not require indemnification for Go Ape’s own negligence or conduct to the extent prohibited by law.

15. Governing law and disputes

This Website is controlled and operated by Go Ape from its offices in Maryland and is targeted at U.S. residents only. These Terms are governed by the laws of the State of Maryland, without regard to conflict-of-law principles, except that mandatory consumer-protection laws of your state of residence may also apply. Unless applicable law requires otherwise, claims relating solely to the Website must be brought in the state or federal courts located in Frederick County, Maryland, and each party consents to personal jurisdiction there.

16. Changes to these Terms

We may update these Terms from time to time. The “Last updated” date identifies the current version. Changes become effective when posted or on a later date stated in the revised Terms. Material changes will be communicated as required by law. Changes will not retroactively alter a completed transaction unless permitted by the transaction terms and applicable law.

17. General provisions

If any provision is held unenforceable, it will be modified to the minimum extent necessary or severed, and the remaining provisions will remain effective. A failure to enforce a provision is not a waiver. You may not assign these Terms without our written consent; Go Ape may assign them in connection with a reorganization, merger, sale, or transfer of the relevant business. Headings are for convenience only. Provisions that by their nature should survive termination will survive, including Sections 12-15.

It also explains the choices and privacy rights that may be available to you. This Privacy Policy should be read together with the Website Terms of Use, the Booking Terms, and any additional privacy notice presented in connection with a particular product, service, or promotion. Capitalized terms not defined in this Privacy Policy have the meanings given to them in the Booking Terms.   • Affiliated Go Ape entities and locations.

These third parties may provide services related to any of the purposes described in Section 4, and we may share with them any types of information described in Section 2. Your information may also be collected and processed by third parties, such as the payment providers you select, who will process your information independently in accordance with their own privacy notices. No mobile information will be shared with third parties/affiliates for marketing or promotional purposes. All other categories exclude text messaging originator opt-in data and consent; this information will not be shared with any third parties.

7. Marketing communications

Emails: You may unsubscribe from marketing email by using the link in the message or contacting us.

SMS Messaging: We won’t send you any text messages unless we have appropriate consent to send them. You may opt out of marketing text messages by replying STOP or following the instructions in the message.

Service-related emails or messages, such as booking confirmations or safety notices, are not marketing and may continue while needed to provide the requested service.

8. Data retention

We retain personal information only for as long as reasonably necessary for the purposes described in this Policy, including to provide Services, maintain transaction and safety records, administer memberships and gift balances, comply with legal, tax, insurance, and accounting requirements, resolve disputes, and enforce agreements. Retention periods vary by category and context. When information is no longer needed, we delete, deidentify, or securely dispose of it, subject to legal and operational limitations.

We maintain administrative, technical, and physical safeguards designed to protect personal information. No method of transmission or storage is completely secure, and we cannot guarantee absolute security. You should use unique passwords, protect booking and membership codes, and notify us promptly of suspected unauthorized activity.

10. Children and minors

Our general-audience Website is not directed to children under 16, and we do not knowingly collect personal information online directly from children under 18 without legally sufficient parental consent. Parents, guardians, or group organizers may provide information about minors for bookings, waivers, safety, memberships, or activities. If you believe a child provided personal information inappropriately, contact us so we can review and take appropriate action.

11. U.S. state privacy rights

Depending on where you reside and whether the applicable law covers Go Ape, you may have rights to:

  • confirm whether we process your personal information and access or receive a copy of it;
  • correct inaccurate personal information;
  • delete personal information, subject to exceptions;
  • obtain data portability;
  • opt out of sale, sharing, targeted advertising, or certain profiling;
  • limit certain uses or disclosures of sensitive personal information;
  • withdraw consent where processing is based on consent;
  • appeal a decision on a request; and

Our Privacy Policy describes the limited circumstances in which we may share your information with third parties. If you are a California resident, California Civil Code Sections 1798.100 and 1798.105 permit you to make requests to access categories and specific pieces of personal information about you, as well as to request to delete personal information about you under certain circumstances. Memberships, passes, promotions, discounts, and loyalty benefits may involve the collection or use of personal information. Third-party sites and services operate under their own privacy notices. We encourage you to review those notices. Go Ape is not responsible for third-party privacy or security practices.

RESERVATION BOOKING TERMS

RESERVATION BOOKING TERMS

These Reservation Booking Terms (the “Booking Terms”) govern reservations for Go Ape Activities and related services and products, including booking acceptance, payment, arrival and check-in, participant responsibilities, eligibility and safety requirements, cancellations, rescheduling, no-shows, operational changes, refunds, promotions, and other booking-related matters. They should be read together with the applicable Rules of Participation, Assumption of Risk and Release of Claims Waiver (the “Waiver”), Privacy Policy, and any Group Booking Terms, third-party vendor terms, or product-specific terms that apply to a particular reservation. These Booking Terms also provide the principal definitions used across Go Ape’s linked transaction policies. Unless a linked policy expressly provides otherwise, capitalized terms used but not defined in that linked policy have the meanings given to them in these Booking Terms. If more specific terms applicable to a Group Booking, third-party purchase, product, or promotion conflict with these Booking Terms, the more specific terms will control for that transaction.

1. Agreement and scope

These Booking Terms apply to any and all reservations for activities, services and or ancillary products offered by Adventure Forest LLC or any of its affiliates or subsidiaries, including but not limited to the applicable subsidiary operating entity identified in the booking confirmation (collectively, “Go Ape,” “we,” “us,” or “our”). Covered offerings may include, but are not limited to, the Go Ape Treetop Adventure course, the Go Ape Treetop Journey Course, Go Ape Nets course, Axe Throwing, Forest Escape, teambuilding and leadership development events, and related products (the “Activities”).

These Booking Terms contain important information concerning all participants of Go Ape Activities. Please read these Booking Terms carefully. By booking with Go Ape or participating on any of its Activities, you acknowledge that you and members of your party have read, understood, and agree to be bound by these Booking Terms.   

The person making the reservation (“Booking Customer”) is responsible for providing accurate information, paying all charges, and communicating these Booking Terms and applicable participation requirements to every participant. Except where permitted by law, a Booking Customer shall not sign a Waiver on behalf of another competent adult.

Participation is subject to the applicable Rules of Participation and Waiver, which shall be completed prior to participation in the Activities. Each adult participant, and a parent or legally authorized guardian for each minor participant, must complete required Waiver before participation.

2. Booking acceptance and confirmation

A reservation for a booking is not accepted until Go Ape issues a written or electronic confirmation (“Booking”). Review the confirmation promptly and notify us of errors. Go Ape may correct obvious clerical, technical, inventory, or pricing errors, subject to applicable law. Activity availability, schedules, and capacity remain subject to operational and safety requirements.

3. Arrival, check-in, and late arrivals

Participants must arrive by the check-in time stated in the Booking confirmation or pre-arrival instructions, with required identification, completed documents, and appropriate clothing.

Late arrival may result in shortened participation, reassignment to a later time if available, or refusal of participation. A late arrival is subject to the No-Show Policy unless Go Ape agrees otherwise in its sole discretion. Travel delays, parking, and difficulty locating the venue are the guest’s responsibility.

4. Participant responsibility and safety

The Activities may include challenging zip line and high ropes obstacle courses, axe throwing, or of other high-risk nature. Participation involves inherent and other risks, which may include falls, collisions, falling objects, equipment use, physical exertion, exposure to weather, serious injury, permanent disability, or death. Risks and legal releases are addressed more fully in the required Waiver. Participants must attend required safety instruction prior to participation, follow all directions and posted rules, use equipment as instructed, and act responsibly and courteously.

After the safety instruction, Activities are navigated independently and participants are not supervised by Go Ape personnel. Participants remain responsible for following safety procedures and supervision requirements for minors.

Go Ape reserves the right to refuse admittance to the Activities or to remove a participant from the Activities should it deem it necessary to do so in its sole discretion, including but not limited to, for reasons involving violation of safety rules. Go Ape personnel may intervene, restrict, or end participation when reasonably necessary for safety or operations.

5. Eligibility, health, and participation requirements

Age, height, weight, supervision, footwear, clothing, physical-capability, and other requirements vary by Activity and are stated in the Rules of Participation or Activity description. Participants are responsible for reviewing those requirements before booking.

The Activities are physically demanding and require a degree of agility, strength, and stamina. Participants are responsible for assessing whether they can safely participate. A person with a medical condition, disability, pregnancy, recent injury, medication effect, or other concern should consult an appropriate medical professional where needed and contact Go Ape in advance to discuss essential eligibility requirements and available reasonable modifications. Go Ape does not provide medical advice. Participants are required to certify that they do not suffer from any medical condition which would make it more likely that they would be involved in any incident which could result in injury to themselves or others.

A participant must not participate while impaired by alcohol, cannabis, illegal drugs, or medication that affects safe participation. Go Ape may refuse admission or remove a person reasonably suspected of impairment or unsafe conduct, without refund, credit, or rescheduling, to the extent permitted by law.

6. Clothing, personal property, and conduct

Participants must wear activity-appropriate clothing and closed-toe, secure footwear and must secure loose items as directed. Go Ape may refuse participation where attire or equipment creates a safety risk. Guests are responsible for personal property. To the extent permitted by law, Go Ape is not responsible for loss, theft, or damage to property.

Harassment, threats, violence, deliberate rule violations, unauthorized commercial activity, and disruptive or abusive conduct are prohibited. Go Ape may remove or refuse service to a person whose behavior threatens safety, operations, staff, or other guests.

7. Cancellation Policy

7.1 Cancellation or Rescheduling Requests. Cancellation or rescheduling requests for Bookings must be submitted through the Self-Service Portal or by contacting the booking line at 1-800-971-8271. The Booking Customer is responsible for obtaining confirmation that the request was received.

A Booking may be cancelled or rescheduled until the time of the scheduled Booking as shown in the Booking confirmation email through the Self-Service Portal. No monetary refunds shall be given for guest initiated rescheduled Bookings or cancellations. Bookings cancelled prior to their scheduled booking time shall be issued a refund gift card in the amount paid for the cancelled portion, less applicable fees. The refund gift card is subject to the Passes, Memberships, Gift Cards & Rainchecks Terms.

Rescheduling is subject to availability, current prices, eligibility rules, and any promotion restrictions. If the replacement booking costs more, the difference is due at rescheduling.

7.2 No-Show Policy. A “No-Show” occurs when a participant or the Booking Customer does not attend at the reserved booking time and Go Ape did not receive notice of cancellation or late arrival prior to the booking time as shown in the Booking confirmation. No-Shows are not eligible for a monetary refund, refund gift card, credit, raincheck, rescheduling, or any other reimbursement. This policy applies to individual participants within a group booking as well as to the entire booking. The entire booking cost shall be forfeited.

7.3 Cancellations under Group Booking Contract. Participants under a Group Booking Contract can find cancellation and related terms within the Group Booking Terms. To the extent of any inconsistency or conflict with these Booking Terms and those in the Group Booking Terms, the terms of the Group Booking Terms shall control.

7.4 Cancellations of Bookings mad through Third Party Vendors. Bookings for Activities purchased through third-party vendors are subject to these Booking Terms and the terms and conditions, including cancellation policies, as set forth in their agreement with such third-party vendor. In the event of any inconsistency or conflict between the two, the terms and conditions with such third-party vendor shall control.

9. Cancellations or operational changes by Go Ape

Go Ape may delay, modify, suspend, or cancel an Activity because of weather, lightning, wind, ice, snow, heat, air quality, staffing, equipment, park closure, emergency, safety concern, government order, or another operational circumstance.

If Go Ape cancels the reserved Activity before participation begins, the Booking Customer may choose, subject to applicable law: (a) rescheduling; (b) a refund gift card for the amount paid for the cancelled Activity; or (c) a monetary refund of the amount paid for the cancelled Activity.

If Go Ape ends an Activity after participation has begun, Go Ape will offer the ability to reschedule for a full booking of the same Activity or to receive a raincheck to schedule the same Activity at a later date. No monetary refund shall be issued.  Unless required by law, incidental expenses such as travel, lodging, parking, food, or time away from work are not reimbursed. Group bookings subject to Group Booking Terms and bookings purchased through third-party vendors shall be subject to the terms and conditions set forth in their respective agreements.

10. Group contracts and third-party bookings

All participants that have booked as a group under Go Ape’s Group Terms shall also be subject to these Booking Terms in addition to the terms and conditions set forth in their Group Booking Contract. In the event of any inconsistency or conflict between the two, the Group Booking Terms shall control.

11. Prices, taxes, fees, and payment

Prices are subject to availability and are subject to change until full payment is completed. Applicable taxes, park admission, parking, facility, booking, or other disclosed fees may be added. Payment is due as stated during checkout or in a written group agreement. All discounts, coupons, promotional codes, or other offers must be applied at purchase and cannot be applied retroactively unless the offer expressly states otherwise.

Go Ape may use third-party payment providers and may take reasonable steps to prevent fraud. If a payment is reversed, disputed, unauthorized, or not completed, Go Ape may cancel the affected booking or require another payment method, subject to applicable law.

12. Promotions and discounts

Go Ape, or authorized third parties, may offer, provide, or otherwise advertise promotions, discounts, sale prices, and codes (“Offers”). Offers are subject to the terms displayed with the specific Offer. Unless stated otherwise, Offers:

  • apply only during the stated booking and redemption periods;
  • are limited to participating products, dates, locations, and customers – please see Offer details for a list of exclusions;
  • cannot be combined, transferred, redeemed for cash or credit, or applied to past purchases;
  • do not apply to taxes, fees, cancellation charges, excluded products, or other miscellaneous charges;
  • cannot be stacked to increase Offer amount, including stacking tickets, activities, passes, gift cards, gift certificates, packages, memberships, bundles, and any other Offer;
  • are limited to one per transaction or customer, unless stated otherwise in the Offer details; and
  • may be corrected, suspended, or cancelled in cases of error, fraud, misuse, or circumstances affecting fair administration, subject to applicable law;
  • are void where prohibited by law.

If you cancel a Booking purchased with an Offer, any applicable monetary refund or refund gift card will equal the amount paid. Rescheduling of your Booking purchased with an Offer is subject to the Cancellation Policy and prices in effect at the time of Booking, except where usage restrictions apply. Where a specific Offer is subject to usage restrictions, Offer shall be void if rescheduling outside of usage restriction, please see specific details of the Offer.

13. Refund administration

When these Booking Terms expressly authorize a monetary refund, it will ordinarily be returned to the original payment method. If that method is unavailable or multiple methods were used, Go Ape may issue the refund by another lawful method. Processing times vary by financial institution. Gift-card and certificate payments will be restored to the applicable stored-value instrument unless law requires otherwise.

14. Merchandise

All sales of merchandise are FINAL. No refunds or credits shall be permitted.

15. Limitation of liability

To the fullest extent permitted by law, Go Ape is not liable for the loss or damage of or to any property or to any person arising from the Booking of or participation in the Activities. Go Ape shall not be liable for any indirect, incidental, special, punitive, exemplary, or consequential damages. Any liability of Go Ape shall be limited to the refund of any charges to Go Ape.

16. Force majeure

Go Ape will not be responsible for delay or failure caused by events beyond its reasonable control, including severe weather, natural disaster, epidemic, government action, utility or communications failure, park closure, civil disturbance, labor disruption, or similar event. This section does not eliminate any remedy expressly provided in Section 9 or required by law.

17. Privacy

Go Ape handles personal information as described in its Privacy Policy. Booking Customers should not provide sensitive information about another person unless authorized and reasonably necessary for the booking or safety process.

18. Governing law and general terms

18.1 Governing Law and Venue. These Booking Terms are governed by and interpreted in accordance with Ohio law, and participants on the Activities agree to submit to the exclusive jurisdiction of Ohio.

18.2 Survival. If any of these Booking Terms are determined to be illegal, invalid, or otherwise unenforceable, it shall be severed and deleted from these Booking Terms and the remaining Booking Terms shall survive, in full force and continue to be binding and enforceable. 

18.3 Waiver. No waiver is continuing unless stated in writing.

These Passes, Memberships, Packages/Bundles (“Packages”), Gift Cards & Rainchecks Terms explain the conditions that apply to the purchase, registration, renewal, cancellation, use, transferability, redemption, expiration, suspension, and termination of the applicable Go Ape product. The specific benefits, participating locations, validity period, restrictions, and other product details disclosed at the time of purchase also form part of these terms. Reservations made or Activities purchased or accessed using a Membership, Card, Pass, Package, or Raincheck remain subject to the Booking Terms, applicable Rules of Participation, Waivers, and the Privacy Policy. Capitalized terms not defined in these terms have the meanings given to them in the Booking Terms. If product-specific terms presented at purchase conflict with these general terms, the product-specific terms will control for that product.

Part A — General Membership Terms

1. Agreement and relationship to other terms

These terms govern all annual memberships, monthly memberships, national or location passes, frequent-participant products, and or similar admission products identified at purchase (each, a “Membership”). The Membership purchaser and registered holder agree to these terms and the Booking Terms as a condition of purchase. Participation remains subject to the applicable Booking Terms, Go Ape Rules of Participation and required participant Waiver. If product-specific terms conflict with these general Membership terms, the product-specific terms control.

2. Registered holder and non-transferability

A Membership is issued to one named individual (“Member”) and is not transferable, shareable, or resalable. The Member must provide accurate registration information and present government-issued or other approved photo identification at check-in. Pass codes and credentials must be kept confidential and may be used only by the registered Member.

3. Activation

Upon purchase of a Membership, Members will be provided with a code that is unique to their registration information (“Membership Code”). Advanced reservations online are required and Members must apply their Membership Code at checkout. Any attempt to gain admission to a Go Ape Activity using a Membership Code by a guest to whom the Membership Code was not issued will result in immediate termination of the Membership without refund.

4. Reservations and availability

Advance reservations are required unless Go Ape states otherwise. A Membership does not guarantee availability, priority access, or admission on a particular date or time. Access is subject to operating calendars, capacity, staffing, weather, park access, closures, blackout dates, maintenance, safety requirements, and other reasonable operational restrictions disclosed with the product.

5. Included and excluded benefits

A Membership includes only the Activities, locations, and benefits stated in the product description at purchase. Fees for parking, park admission, merchandise, food, special events, games, premium products, third-party services, and separately priced activities are excluded.

6. Use, cancellations, and no-shows

Members must follow the Booking Terms, including advance cancellation and no-show requirements. Because Membership reservations may prevent other guests from booking, repeated no-shows or misuse may result in a warning, temporary suspension, or termination of the Membership without refund.

7. Misuse and termination

Unauthorized use, production, fraud, resale, credential sharing, impersonation, repeated no-shows, abusive conduct, or material violation of safety or product terms are prohibited and may result in denial of admission, suspension, or termination without refund.

8. Changes to operations and benefits

Go Ape may make changes to operating hours, schedules, reservation procedures, safety rules, or incidental benefits. Changes to future terms will be communicated before they apply.

Part B — Annual Membership

9. Purchase and term

An Annual Membership may be purchased online or in person from participating locations. It begins on the date of purchase and auto-renews annually. It is valid only at the location of purchase. Go Ape may choose to allow members to attend other locations by calling in advance to make their reservation to 1-800-971-8271. No extension is provided for ordinary or seasonal closures or days the Member does not use the Membership, except as required by law or expressly announced by Go Ape.

10. Annual Membership Billing and Cancellation

The Annual Membership auto-renewed charges will occur on or about the annual anniversary of the Annual Membership purchase date. You authorize Go Ape and its payment provider to charge the stored payment method until cancellation. You may cancel by looking up your membership through the Member Portal and cancelling your Annual Membership; by calling 1-800-971-8271; or by emailing [email protected]. Cancellation takes effect at the end of the current billing period.  Requests must be received 15 days prior to the end of the billing period. We will provide an acknowledgment of cancellation. Price changes will be communicated at least seven (7) days before the next charge, as required by law.

If a payment fails, Go Ape may retry the payment, suspend benefits, or cancel the Membership after notice. No partial-month refund is provided unless required by law.

Go Ape will provide annual renewal notices at least 30 days in advance of the auto renewal via email.

11. Annual benefits

The Annual Membership grants a revocable right to the Member for admission to participate on the Go Ape Activity available at the participating location, unless otherwise restricted by applicable Safety Rules and subject to availability as set forth in Section 4. Benefits are subject to availability and the exclusions in Part A.

The Annual Membership may include discount offers to Member’s friends and family that reserve a booking with the Member (“Guest Discount”). Guest Discounts cannot be redeemed without the Member present. Additional discounts for merchandise and other benefits may also be available to Members as advertised by Go Ape from time to time. Promotional or discretionary benefits may change in the sole discretion of Go Ape.

12. Payment, cancellation, and refunds

The purchase price is due at purchase. The Annual Membership automatically renews. Annual Memberships are nonrefundable and have no cash value after activation, except as required by law. The Annual Membership cannot be refunded or exchanged for cash.

Part C — Monthly Membership

13. Monthly Membership Purchase

The Monthly Membership automatically renews each month until cancelled, and the payment method is charged the then-current monthly price plus applicable taxes and fees. The checkout page will clearly disclose renewal terms and obtain affirmative consent.

As disclosed on the checkout page, by clicking “Purchase” of the Monthly Membership, you agree to our monthly membership service. You will be charged the Monthly Membership fee plus taxes and fees every month of your Monthly Membership.

Part D — Gift cards, Gift Certificates, and Refund Gift Cards Terms

17. Issuer and acceptance

Go Ape gift cards, gift certificates, and refund gift cards, in physical or digital form, (collectively, “Cards”) are issued by Go Ape Lake Needwood LLC, a Maryland limited liability company, which reserves the right to amend these terms at any time.

Purchasing, accepting, or using a Card constitutes acceptance of these terms (Cards Terms). Booking Terms apply to any Activity purchased with a Card.

18. Redemption

Cards may be redeemed at participating U.S. Go Ape locations or online at www.goape.com, subject to the product restrictions stated on the Card. Refund Gift Cards and Gift Cards may be redeemed as part or full payment towards any Go Ape Activity or Go Ape merchandise. Gift certificates restricted to a specified Activity may be used only for that Activity unless Go Ape agrees otherwise. Gift Cards and Gift Certificates cannot be used to purchase Annual or Monthly Memberships or any bundled or packaged passes or tickets.

19. Balances and split payment

If a purchase is less than the available balance, the unused balance remains available. If a purchase exceeds the balance, another accepted payment method may be used for the difference. Balance information is available by calling Go Ape or emailing [email protected].

20. Expiration and fees

Gift cards and refund gift cards do not expire. No inactivity or service fee is charged. Activity-specific certificates and promotional cards may have different lawful expiration terms clearly disclosed at issuance. Federal and state law control if they provide greater rights.

21. Cash redemption and refunds

Cards are not redeemable for cash and are not refundable, except as required by law. Where state law requires cash redemption of a low balance or another form of payment, Go Ape will comply. Refunds for purchases made with a Card are generally returned to the Card or another Go Ape stored-value instrument, unless law requires otherwise.

22. Lost, stolen, or unauthorized Cards

Treat a Card like cash. Go Ape is not responsible for unauthorized use. Cards cannot be replaced if lost, stolen or destroyed. Unauthorized use, production, or sale is strictly prohibited.

Part E — Rainchecks

23. Issuance and permitted use

A raincheck is a noncash issuance by Go Ape for a specified Activity and location. It may be used only as stated on the raincheck and is subject to availability, current participation requirements, and reservation procedures. It may not be used for another product or location unless Go Ape approves in writing. Rainchecks are have no cash value and cannot be refunded or exchanged for cash. Rainchecks are non-transferable.

24. General provisions and contact

Go Ape may update these terms for future purchases and renewals. The terms in effect at purchase govern the paid term except for lawful safety and operational changes. If a provision is unenforceable, the remainder remains effective. Questions should be directed to [email protected].

These Sweepstakes & Promotions Terms contain the standard conditions applicable to Go Ape discounts, coupons, complimentary items, gifts with purchase, giveaways, sweepstakes, contests, and similar promotional programs. Each Promotional Offer or Sweepstakes may also be subject to additional eligibility requirements, entry instructions, dates, geographic restrictions, prize details, redemption conditions, and other terms stated in the applicable advertisement or official campaign materials. Personal information collected in connection with a promotion will be handled in accordance with the Privacy Policy, and any booking or participation obtained through a promotion remains subject to the Booking Terms, applicable Rules of Participation, and required Waiver. Capitalized terms not defined in these Sweepstakes & Promotions Terms have the meanings given to them in the Booking Terms. If the terms of a specific Promotional Offer or Sweepstakes conflict with these general terms, the offer- or sweepstakes-specific terms will control.

Part A — Standard Promotion Terms for Discounts and Free Gifts (“Standard Promotion Terms”)

1. Scope

Go Ape may advertise promotional offerings in which an item of value is offered for free or at a discount. These Standard Promotion Terms apply to Go Ape discounts, coupons, complimentary items, gifts with purchase, limited-time offers, and similar promotions that are not sweepstakes or skill contests (“Promotional Offers”). Additional terms displayed with a Promotional Offer also apply. If the offer-specific terms conflict with these Standard Promotion Terms, the offer-specific terms control.

2. Eligibility and period

A Promotional Offer is valid only for eligible customers, participating products and locations, and the booking or redemption period stated in the advertisement. Promotional Offers are void where prohibited and while supplies or eligible inventory last. Promotional Offers may not be stacked. Proof of eligibility may be required.

3. General restrictions

Unless stated otherwise, Promotional Offers:

  • are limited to one per customer or transaction;
  • must be applied at purchase and cannot be applied retroactively;
  • cannot be combined, transferred, sold, exchanged, or redeemed for cash or credit;
  • may not be stacked;
  • do not apply to taxes, fees, prior purchases, excluded products, or unauthorized transactions; and
  • may be suspended or cancelled in cases of error, fraud, abuse, supply interruption, or circumstances that materially affect fair administration, subject to applicable law.

4. Gifts with purchase

A complimentary or discounted gift has no cash value and cannot be returned, exchanged, or redeemed for cash or credit. Go Ape may substitute an item of equal or greater stated retail value if the advertised gift becomes unavailable. If a qualifying purchase is cancelled or returned, the gift must also be returned in its original condition, or the disclosed value of the gift may be deducted from any credit or refund to the extent permitted by law.

Part B — Go Ape Giveaways, Sweepstakes & Contests Official Rules

Go Ape promotes a variety of giveaways and contests from time to time through various channels. All sweepstakes, giveaways, and contests by Go Ape in which a winner is selected at random will be considered a “Go Ape Sweepstakes,” and are subject to these Official Rules. NO PURCHASE OF ANY KIND IS NECESSARY TO ENTER OR WIN A GO APE SWEEPSTAKES. A PURCHASE WILL NOT INCREASE YOUR CHANCES OF WINNING. GO APE SWEEPSTAKES ARE VOID WHERE PROHIBITED BY LAW

Eligibility: Go Ape Sweepstakes are open only to legal residents of the United States who are at least 18 years of age or older and the legal age of majority in the jurisdiction at the time of entry.
