BOOKING TERMS & CONDITIONS

1. Overview

a. These Booking Terms and Conditions (the “Terms”), as may be amended from time to time, apply to any and all activities or services booked with Adventure Forest LLC, or any of its affiliates or subsidiaries, (collectively, “Go Ape”), including but not limited to the Go Ape Treetop Adventure course, the Go Ape Treetop Journey course and any ancillary products at the location set out in Go Ape’s booking confirmation, including but not limited to Axe Throwing and the Monkey Drop (the “Activities”).

b. These Terms contain important information concerning all participants of Go Ape Activities, including you and members of your party. Please read these Terms carefully, as by booking with Go Ape or participating on any of its Activities, you acknowledge that you and members of your party have read, understood, and agree to be bound by these Terms. No variation to these Terms shall be binding unless agreed in writing by Go Ape.

c. Any typographical clerical or other error or omission in any booking confirmation or other documentation issued by Go Ape (including any electronic documentation) shall be subject to correction without any liability on the part of Go Ape.

d. These Terms incorporate Go Ape’s Privacy Policy, Assumption of Risk and Release of Claims form, and Rules of Participation. You and each member of your party will be required to sign the Assumption of Risk and Release of Claims form before being allowed to undertake the Activities.

e. Go Ape reserves the right to make changes to the Activities in its sole discretion.

2. Group Bookings via Group Booking Contract

All participants that have booked as a group under Go Ape’s Group Booking Contract shall be subject to these Terms and the terms and conditions set forth in their Group Booking Contract. In the event of any inconsistency or conflict between the two, the terms and conditions of the Group Booking Contract shall control.

3. Booking Confirmation

a. No booking shall be deemed accepted unless accepted in writing by Go Ape (which shall include acceptance via Go Ape’s email confirmation of booking).

b. You must advise Go Ape as soon as possible of any mistake in Go Ape’s booking confirmation. Go Ape shall use its commercially reasonable efforts to ensure that you and your party’s participation commences at the time booked and it shall be the responsibility of each participant to ensure that they arrive in sufficient time. Late arrivals are subject to Go Ape’s No-Show Policy and may not be permitted to undertake the Activities based on availability in Go Ape’s sole discretion.

4. Safety

a. The Activities may be comprised of challenging zip line and high ropes obstacle courses, axe throwing, or of other high-risk nature and participation is not without risk, including permanent disability and or death. All participants will receive detailed safety training from a Go Ape instructor prior to participation.

b. Go Ape reserves the right to refuse admittance to the Activities or to remove a participant from the Activities should it deem it necessary to do so in its sole discretion, including but not limited to participants in violation of safety rules and those deemed to be under the influence of alcohol or drugs.

c. After the safety briefing provided by Go Ape instructors, participants are not supervised by Go Ape personnel. Participants must acknowledge and adhere to all safety rules, including supervision requirements for minors as set forth in Go Ape’s Rules of Participation for a specific Activity.

d. The Activities are physically demanding and require a degree of agility, strength, and stamina. Participants are responsible for assessing their own suitability and capability to participate on the Activities. If participants have any doubt as to whether they should attempt the Activities, they are advised to walk the course or preview the specific Activity before booking. If participants have medical concerns, they are advised to consult with a doctor in advance. Participants are required to certify that they do not suffer from any medical condition which would make it more likely that they would be involved in any incident which could result in injury to themselves or others. Due to the physical nature of the Activities, Go Ape recommends that pregnant women not participate in the Activities.

e. Participants need to be able to see similar distances to those required to drive a car. Accordingly, short or long-sighted participants must ensure that they wear contact lenses or prescribed glasses.

f. All participants are required to act responsibly and courteously at all times and to respect other participants. Go Ape shall be entitled to prohibit any person from undertaking or completing the Activities in the event it deems the behavior of any participant unsuitable.

g. Participants must be dressed appropriately. Go Ape reserves the right to refuse admittance to the Activities to any participant who is not appropriately dressed.

h. The Activities will remain open in most weather conditions (but not in circumstances of heavy winds, lightning, heavy ice or snow).

h. No refunds, credits  or other compensation will be payable by Go Ape in the event that any participant is not permitted to, or decides not to, undertake or complete the Activities for the reasons set out in this Section 4.

5. Cancellation Policy

a. Cancellation or rescheduling requests must be made by contacting the booking line at 1-800-971-8271. Participants are responsible for ensuring that Go Ape receives the request.

Participants canceling 7 days or more prior to the reserved booking date will have the option of rescheduling the booking, receiving a gift card allowing them to reschedule at a later date, or a full monetary refund. Applicable non-refundable online transaction fees shall apply to all partial refunds of a booking. Participants canceling less than 7 days prior to the reserved booking date will not receive a monetary refund but may reschedule the booking or receive a gift card allowing them to reschedule at a later date. However, if canceling less than 48 hours prior to your scheduled booking, rescheduling the booking or receiving a gift card is subject to a FIVE DOLLAR ($5.00) administrative fee per ticket. This amount will be charged at the time of rescheduling or deducted from the refund gift card issued to the participant. No monetary refunds will be given for rescheduled bookings.

Participants that do not show at the reserved booking time without prior notice of cancellation or late arrival shall be subject to the NO-SHOW policy and will not be eligible for a monetary refund, rescheduling, or other credit. The Cancellation Policy as set forth here is applicable to all participants, including but not limited to individual participants within a group booking.

b. NO SHOW POLICY. In fairness to all guests, participants with reserved bookings who fail to show at their reserved booking time and provide no prior notice of cancellation are liable for the entire booking cost. The No-Show Policy as set forth here is applicable to all participants, including individual participants within a group booking.

*No-shows shall not be eligible for a monetary refund, credit, refund gift card, rescheduling of the event, or any other reimbursement. The entire booking cost shall be forfeited.

c. Cancellations under Group Booking Contract. Please note that participants booking under a Group Booking Contract can find cancellation and related details within their contract. To the extent of any inconsistency or conflict with these Terms and those in their Group Booking Contract, the terms of the Group Booking Contract shall control.

d. Cancellations of Bookings made through Third Party Vendors. Bookings for the Activities purchased through third-party vendors are subject to these Terms and the terms and conditions, including cancellation policies, as set forth in their agreement with such third-party vendor. In the event of any inconsistency or conflict between the two, the terms and conditions with such third-party vendor shall control.

6. Cancellations on Behalf of Go Ape

a. In the event Go Ape needs to close an Activity prior to your booking, participants will have the option to reschedule the booking, receive a refund gift card in the amount of the cancelled booking, or a full monetary refund.

b. In the event an Activity needs to close during your adventure, participants will have the ability to reschedule for a full adventure at a later date or receive a raincheck to schedule at a later date. Under these circumstances, no monetary refunds will be issued.

c. Contractual group bookings and bookings purchased through third-party vendors shall be subject to the terms and conditions set forth in their respective agreements, including terms related to cancellations on behalf of Go Ape.

7. Price and Payment

All prices are subject to availability. Prices are subject to change until full payment is received. Subject to any terms agreed in writing between Go Ape and you, all charges shall be calculated at current rates and payment in full shall be due at the time of purchase. All discounts, coupons, promotional codes, or offers of any nature must be given at the time of the purchase. Payment may be made by debit or credit card either online at goape.com or by contacting the booking line on 1-800-971-8271.

8. Promotions, Discounts, Sale Pricing, and Other Price Changes

a. From time to time, Go Ape, or authorized third parties, may offer, provide, or otherwise advertise promotions, discounts, sale pricing or otherwise modify pricing for its Activities (“Offers”).  Offers cannot be applied to previously purchased bookings or used in combination with other offers. Offers are not transferable or redeemable for cash or credit.  Certain products, services, or Go Ape locations may be excluded from Offers, please see specific details of the Offer for a list of exclusions.  Go Ape reserves the right to modify or cancel any and all Offers at any time. Offers are limited to one per customer, unless specifically stated otherwise in the Offer details. Offers cannot be redeemed against taxes, fees, cancellation charges or other miscellaneous charges, which are the sole responsibility of the customer. Offers are void where prohibited by law. Offers are valid only during the applicable redemption period as set forth in the Offer details.

b. If your booking purchased with an Offer is cancelled by you, any applicable monetary refund or refund gift card will equal the amount paid. Rescheduling of your booking purchased with an Offer is subject to the Cancellation Policy and prices in effect at the time of booking, except where usage restrictions apply. Where a specific Offer is subject to usage restrictions, Offer shall be void if rescheduling outside of usage restriction, please see specific details of the Offer.  

9. Refunds

a. Payments made by debit or credit card will be refunded to the same card or, if the card has subsequently expired, by check. Payments made by Gift Card, Refund Gift Card or Gift Certificate shall be refunded to the same card.

b. Where multiple forms of payment are used, Go Ape reserves the right to refund any monies due on a refund by credit, check or refund gift card.

c. All sales of merchandise are FINAL. No refunds or credits shall be permitted.

10. Limitation of Liability

a. Except as otherwise provided in these Terms, Go Ape shall not be responsible for the loss, or damage, of or to any property or to any person arising from the booking of or participation in the Activities.

b. Except as otherwise provided in these Terms, any liability of Go Ape shall be limited to the refund of any charges paid to Go Ape.

11. Privacy

Go Ape respects your privacy. Please review our Privacy Policy, which is incorporated herein, for further information.

12. Miscellaneous

a. If any of these terms are determined to be illegal, invalid or otherwise unenforceable it shall be severed and deleted from these Terms and the remaining Terms shall survive, remain in full force and continue to be binding and enforceable.

b. Nothing above shall confer on any third party any benefit or the right to enforce any of these Terms.

c. These Terms shall be governed by and interpreted in accordance with the laws of Maryland and you agree to submit to the exclusive jurisdiction of the courts of Frederick County, Maryland.

GIFT CARD TERMS & CONDITIONS

RAINCHECK TERMS & CONDITIONS

Rainchecks are issued to participants by Go Ape in its sole discretion. Rainchecks have no cash value and cannot be refunded or exchanged for cash.

Rainchecks may be redeemed exclusively towards the Activity at the Go Ape USA location of issuance, both of which shall be identified on the Raincheck.

Rainchecks may not be redeemed for any other product, service or Activity of Go Ape or its affiliates unless agreed in writing by Go Ape.

MEMBERSHIP TERMS & CONDITIONS

A Go Ape Membership is valid at any Adventure Forest LLC affiliated entity (“Go Ape”) in the United States and grants a revocable right to the registered member for admission to participate on the Go Ape Activity purchased via the membership, either the Treetop Adventure courses, Treetop Journey courses, or Axe Throwing ranges (“Go Ape Course”), unless otherwise restricted by the applicable Safety Rules of Participation found at goape.com. The Membership permits access on any regularly scheduled operating day of the year for which the Membership was issued, subject to course availability based upon weather, staffing, and other operational requirements in Go Ape’s sole discretion. Members shall also be entitled to a discount for all individuals that reserve a booking with them (“Guest Discount”). Additional discounts for merchandise and other benefits may also be available to Members as advertised by Go Ape from time to time. Fees for parking, merchandise, park entrance, games, and other events requiring separate fees are not included.

Upon purchase of a Go Ape Membership, Members will be provided with a promo code that is unique to their registration information (“Membership Promo Code”). Advanced reservations online are required. Members must apply their Membership Promo Code online at checkout while on the exclusive member booking portal. To obtain the Guest Discount, the additional individuals must reserve under the Member’s booking through the exclusive member booking portal. Members must show a photo identification when checking in at the cabin for your reservation. Members must be present on the day of the reservation for the Guest Discount to be applicable. Membership Promo Codes cannot be shared with or used by anyone other than you as the official Go Ape Member. Any attempt to gain admission using a Membership Promo Code by a guest to whom the code was not originally issued will result in immediate termination of the Membership Promo Code without refund. Unauthorized use, production or sale of the Membership Promo Code is prohibited. The Go Ape Membership cannot be cancelled, refunded, or exchanged for cash, except as required by law. Access and participation on Go Ape Courses by Members and their guests is subject to these Membership Terms and Conditions and the Booking Terms and Conditions set forth at goape.com, including cancellation policies (the “Terms”). In the event of any inconsistency or conflict between the two, the Membership Terms and Conditions shall control. Purchase or use of a Go Ape Membership and or booking with Go Ape constitutes acceptance of the Terms. Go Ape reserves the right to amend the Terms at any time in its sole discretion.

FREQUENT FLYER/THROWER/CLIMBER PASS TERMS & CONDITIONS

A Frequent Flyer Pass, Frequent Thrower Pass or Frequent Climber Pass (“FFP”) grants admission to participate on the activity purchased for the allotted number of uses as set forth on the FFP (“Uses”), unless otherwise restricted by the applicable Safety Rules of Participation found at goape.com, at any Adventure Forest LLC affiliated entity (“Go Ape”) location. The FFP purchaser will receive an email with the FFP stating the Go Ape activity and number of Uses purchased. It may be redeemed at a location or online at goape.com on any regularly scheduled operating day, subject to course availability based upon weather, staffing, and other operational requirements in Go Ape’s sole discretion. Only one (1) FFP Use may be applied per reservation.

Cancellation or rescheduling requests must be made by contacting the booking line at 1-800-971-8271. FFP holders are responsible for ensuring that Go Ape receives the request. FFP holders cancelling a reserved booking prior to their reserved booking time may reschedule their booking or receive the allotted Use back on their FFP. FFP holders that do not show for the reserved booking time without prior notice of cancellation or late arrival shall be subject to the NO SHOW POLICY and will not be eligible for rescheduling, Use reimbursement, or any other credit. In the event Go Ape needs to close the course prior to your booking, FFP holders will have the option to reschedule the booking or receive the Use back on their FFP. All individuals reserving in the same booking as the FFP holder are subject to Go Ape’s standard booking cancellation policy.

FFPs cannot be refunded or exchanged for cash, except as required by law. FFPs cannot be replaced if lost, stolen or destroyed. Unauthorized use, production or sale is prohibited, and is the sole responsibility of the FFP holder. Purchase, use, and/or redemption of the FFP constitutes acceptance of these FFP Terms and Conditions and the Booking Terms and Conditions as set forth at goape.com. In the event of any inconsistency or conflict between the two, these FFP Terms and Conditions shall control. Go Ape reserves the right to amend these terms at any time in its sole discretion without notice.

PRIVACY POLICY

Adventure Forest LLC, its agents, subsidiaries and/or affiliates (collectively, “Go Ape,” “we,” and/or “our) know that you care about your privacy. The below information describes our privacy policy and describes the treatment of information provided or collected on its Website. By visiting goape.com and/or using our services, including but not limited to booking with us, participating in surveys, or submitting comments or content, you acknowledge that you have read and are accepting the practices described below. This Privacy Policy may change from time to time and changes are effective upon posting.

We collect information you provide directly to us, or that is transmitted indirectly. For example, when booking with Go Ape, certain personal information is required to process the booking reservation. This includes, but is not limited to, name, address, telephone number, email address, credit card or debit card number and card expiration date, or information relating to your company or organization in the case of a group booking.

Personal information is used to process bookings and provide exceptional customer service to include improvement of services, marketing efforts, and our website. We may use personal information to communicate with you (either directly or through authorized direct marketing agents) about your booking and provide you with information about products, services, upcoming events, and promotions, or other information it is determined you may find interesting. If necessary, Go Ape may disclose personal information to third parties, including but not limited to, insurance companies, financial services entities, authorized direct marketing agents, and when required, by law. Go Ape shall not be responsible or liable for any damages that you or any other person may suffer in connection with the disclosure of such personal information.

Go Ape is committed to protecting your personal information and utilizes industry-standard data protection safeguards. However, in no event shall Go Ape be liable for any direct, indirect, punitive, incidental, special or consequential damages arising out of or in any way connected with a third party’s unauthorized access to your information, regardless of the legal theory and regardless of whether the notice that damages where possible. To the extent this limitation is barred by state law, this limitation shall not apply.

The odds of winning will be determined by the number of entries. Go Ape reserves the right to revise the contest period at any time without prior notification. For any Go Ape contest, including those involving social media, entries will be accepted by mail. The note card must include your name, phone number or email address, mailing address, contest due date and any additional details as required by the specific contest. Participation in a Go Ape Treetop Adventure, Treetop Journey, Treetop Discovery, Monkey Drop or Axe Throwing Activity is subject to Go Ape’s Terms and Conditions and Rules of Participation.

Go Ape is committed to ensuring that your information is secure. In order to prevent unauthorized access or disclosure, Go Ape has put in place commercially reasonable physical, electronic and managerial procedures to safeguard and secure the information collected online. Go Ape provides secure mechanisms for booking reservations by using secure server software which encrypts all personal information entered before it is sent to Go Ape so that it cannot be read by others as it travels over the Internet. All sensitive transactions with Go Ape are carried out using a secure server.

However, in no event shall Go Ape be liable for any direct, indirect, punitive, incidental, special or consequential damages arising out of or in any way connected with your use of the website or a third party’s unauthorized access to your information, regardless of the legal theory and regardless of whether notice that damages where possible. To the extent this limitation is barred by state law, this limitation shall not apply.
